While countless divorces are “uncontested” and settled out-of-court, many are “contested” and litigated in court. An uncontested divorce is possible when the spouses agree that the marriage is to end and reach a mutually satisfying agreement regarding the final divorce settlement. If an out-of-court agreement is reached, there is no need for court appearances or hearings. In a “contested” divorce, the spouses are unable to come to an agreement on one or more issues.
When spouses cannot agree, they appear before a Judge in Court and the Judge makes the final decision on all issues they were not able to negotiate.
When the parties are unable to settle their differences, Ms. Delgado is prepared to handle any issue in a contested divorce action. Since 1994, Ms. Delgado has litigated and tried cases before the Supreme Court of the State of New York, and the Family Court of the State of New York. In countless instances, she has obtained favorable results for her clients.
